THE PROCEDURES AND REQUIREMENTS FOR EXPORTING TIN ORE

THE DIRECTOR GENERAL OF FOREIGN TRADE,

Considering :

that to implement Decree of the Minister of Industry and Trade No. 558/MPP/Kep/12/1998 on general provisions in the export field as has been several times amended the latest by Decree of the Minister of Industry and Trade No. 57/MPP/Kep/I/2002, it is necessary to stipulate the procedures and requirements for exporting tin ore;

In view of :

Letter of the Director General of Geology and Mineral Resources of the Ministry of Energy and Mineral Resources No. 0095/20.01/DJG/2001 dated January 15, 2002;

DECIDES :

To stipulate :

DECISION OF THE DIRECTOR GENERAL OF FOREIGN TRADE ON THE PROCEDURES AND REQUIREMENTS FOR EXPORTING TIN ORE.

Article 1

Hereinafter referred to as tin ore shall be all types of tin ore and its concentrates included in headings HS.2607.00.000 and HS.2609.00.000 as contained in Attachment to Decision of the Minister of Industry and Trade No. 57/MPP/Kep/I/2002.

Article 2

(1) The tin ore as referred to in Article 1 can only be exported by companies or exporters after securing approval from the Director of Farm and Mining Product Export, Directorate General of Foreign Trade, Ministry of Industry and Trade.

(2) The export approval from the Director of Farm and Mining Product Export as referred to in paragraph (1) shall be given by paying attention to and taking into account recommendation and assessment from the Regent/Mayor of the region producing tin ore an the quantity of tin ore that can be exported in relation to the need of the domestic tin processing industry for tin ore.

Article 3

The companies or exporters that can secure the export approval as referred to in Article 2 paragraph (1) shall be:

To secure the export approval, the companies or exporters as referred to in Article 3 shall file applications to the Director of Farm and Mining Product Export by enclosing :

The companies or exporters that have already secured export approval shall report the realization of their exports to the Director of Farm and Mining Product Export, Directorate General of Foreign Trade, Ministry of Industry and Trade, no later than 1 (one) month after the expire date of the export approval.

Article 6

The implementation of provisions on export approval as referred to in this Decision shall be reviewed three months after it took effect.

Article 7

In the event that the L/C of tin ore export is opened by the exporter or company before and on the stipulation date of this Decision, the shipment of tin ore export shall be done no later than February 20, 2002.

Article 8

This Decision shall begin to take effect on the date of stipulation.
